THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NOS.39739, 40647 AND 41249 OF 2017 COMMON ORDER The case of the petitioners in these writ petitions is that the respondents have issued notification dated 17-04-2015 under Section 3(A) of the National High Ways Act, 1956 (for short 'the Act') and declaration under Section 3(D) of the said Act, for acquiring the subject land of the petitioners for formation of Bangalore - Chennai express way. The grievance of the petitioners is that without following the procedure contemplated under Section 3 G (4) of the said Act, the 3rd respondent - Joint Collector, issued proceedings in Roc.No.NHA1/ G1/ 1088/ 2012 dated 27.05.2016 for fixation of compensation.

Heard the learned counsel for the petitioner. The learned Government Pleader for Land Acquisition on producing written instructions would submit that if the writ petitioners or any land loser submit their claim, it will be processed and redressed as per norms and the compensation will be paid as per the Act and that the petitioners may be directed to submit their claims before the competent authority with documentary evidence in support of their claim. In view of the above statement made by the learned Government Pleader, writ petitions are disposed of leaving it open to the petitioners to submit their claims along with necessary documents to the competent authority and the said authority is directed to follow the procedure contemplated under Section 3(G)(4) of the Act and thereafter take appropriate action in accordance with law.

With the above direction the writ petitions are disposed of. Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
