ORDER

This petition under Section 482 of Cr.P.C. is filed to quash the proceedings in Cr.No.152 of 2017 of Mandapeta Rural Police Station, East Godavari District, registered for the offences punishable under Sections 342, 307, 384 read with Section 34 IPC and under Sections 3(1)(r)(s), 3(2)(va) of SCs and STs (POA) Act, against the petitioners/A1 and A2, on the strength of the complaint lodged by the second respondent herein.

Heard learned counsel for petitioners and learned Public Prosecutor for the first respondent-State.

Though the counsel for petitioners raised several contentions, he requested this Court to issue a direction to the Sessions Judge concerned to dispose of the bail application, if any, filed by petitioners under Section 439 of Cr.P.C., on the same day on their surrender before the Court.

Acceding to the request of the counsel for petitioners, without touching the merits of the case, I deem it appropriate to direct the Sessions Judge for Trial of Cases under SCs & STs (POA) Act, to decide the application, if any, filed by petitioners under Section 439 of Cr.P.C., on their surrender, for grant of regular bail, after serving notice on the Public Prosecutor, on the same day, in accordance with law.

With the above direction, the Criminal Petition is disposed of. 6.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
