CVNR, J CRP 6901/2017 ORDER:
This civil revision petition is filed against order dt.06.11.2017 in I.A. No.820 of 2017 in O.S. No.1664 of 2010 on the file of the VI Additional Senior Civil Judge, Visakhapatnam, whereby she has permitted respondent Nos.1 and 2 to cross-examine the petitioner.
At the hearing, Mr. E.V.V.S. Ravi Kumar, learned counsel for the petitioner, submitted that after the notice was issued by this Court, the order under revision worked itself out with the cross-examination of the petitioner/plaintiff No.1. In view of this subsequent event, the cause in the revision petition does not survive for adjudication. However, the learned counsel for the petitioner submitted that in the absence of chiefexamination of the petitioner, her cross-examination is not admissible in evidence.
As the petitioner has already been cross-examined, the admissibility of her evidence is left to be decided by the lower Court, if such a plea is raised on behalf of the petitioner while deciding the suit. Subject to this observation, this civil revision petition is disposed of as infructuous.
CVNR, J CRP 6901/2017 As a sequel to disposal of the civil revision petition, C.R.P.M.P. No.8876 of 2017 shall stand disposed of as infructuous.
