HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.46128 of 2018 ORDER:

The only grievance of the petitioners is that they are in peaceful possession and enjoyment of land to an extent of Ac.63-00 cents in Sy.Nos 118, 150, 151, 153 and 154 of Kommadhi Village, Visakhapatnam Rural Mandal, Visakhapatnam District since the time of their grand father. The subject lands were allotted by Vijayanagaram Samsthanam to their grand father about 70 years back by way of Jurathai as Inam. The Government issued notice dated 21-07-2018 seeking objections that respondents wanted to construct houses for landless persons and asked the land owners to be present along with relevant documents at their lands. Subsequently, without any notice, the respondents straightaway showed the particulars of subject land along with other lands in the list as AWD lands. Aggrieved by the same, the present writ petition is filed.

In this case it is to be seen that no documents are filed to show that the petitioners are in possession of the subject lands except some photographs and some property tax receipts, patta granted by the Vizianagaram Samsthanam, which is also not legible. This Court cannot conduct roving enquiry in the writ petition in respect of disputed questions of fact. Since it is stated that the petitioners already submitted their claims in pursuance to the notice dated 21-07-2018 issued to them, it is for the respondents to consider their claims and take action

in accordance with law. It is open for the petitioners to produce necessary documents.

With the above observations, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 19-12-2018 Nvl
