THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Appeal No.1963 of 2017 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} After putting forth elaborate submissions, both Sri V.Ravinder Rao, learned Senior Counsel appearing on behalf of the appellants, and Sri C.Vivek Sagar, learned counsel for the respondents-writ petitioners, would agree that, since the dispute between the parties relates only to an extent of Ac.0.18 guntas of land in Survey No.142/1/LU of Kompelli Village, Bhoopalpally Mandal, Warangal District, and the land conversion certificate issued by the Revenue Divisional Officer for the remaining extent of Ac.2.20 guntas of land is in order, it would suffice if the order of the Learned Single Judge is affirmed only to the extent of Ac.0.18 guntas of land in Survey No. 142/1/LU of Kompelli Village, Bhoopalpally Mandal, Warangal District for which the land conversion certificate was issued by the Revenue Divisional Officer, Mulug in proceedings No.L/1379/2016 dated 07.10.2016.

As Learned counsel on either side are in agreement, the proceedings of the Revenue Divisional Officer No.L/1379/2016 dated 07.10.2016, granting permission for conversion of an extent of Ac.0.18 guntas of land, in Survey No.142/1/LU of Kompelli Village, Bhoopalpally Mandal, Warangal District, for non-agricultural purposes, is set aside. The order of the Learned Single Judge, to the extent the certificate issued by the Revenue Divisional Officer for conversion of the remaining extent of Ac.2.20 guntas of land in the other survey numbers are concerned was quashed, is set aside. With regards Ac.0.18 guntas of land in Survey No.142/1/LU, the order of the Learned Single Judge,

directing the parties to get appropriate relief in the Civil Court in respect of their respective claims of title, is affirmed. The order under appeal is modified, as indicated hereinabove, and the Writ Appeal is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
