HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL REVISION CASE No.3288 OF 2017 ORDER:

In fact, when the present Criminal Revision Case came up for hearing on 19.12.2017, based on the submission made by the learned counsel for the petitioner that in similar circumstances, this Court disposed of Crl.R.C.No.733 of 2016 on 08.03.2016 and similar order may be passed in the present revision case, this Court dictated orders on the said date disposing of the present revision case in terms of the order dated 08.03.2016 in Crl.R.C.No.733 of 2016. However, as it came to notice that in the present revision, the notice under challenge was issued to the sureties, but the revision is filed by the petitioner - accused, whereas in Crl.R.C.No.733 of 2016, the person to whom the notice was given, himself has filed the revision, this Court posted the matter for further hearing.

Today, when the matter is listed under the caption 'for being mentioned', learned counsel for the petitioner seeks permission to withdraw the present Criminal Revision Petition admitting the aforesaid facts.

Permission is granted.

The Criminal Revision Case is accordingly dismissed as withdrawn recalling the earlier order dictated on 19.12.2017, as this Court is vested with the power to rectify the mistake or error crept in

the order on account of the facts not being properly represented by the counsel for the revision petitioner.

As a sequel, the miscellaneous petitions if any pending shall stand closed.
