HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.42730 of 2017 ORDER:

In this writ petition, the complaint is with regard to grant of building permit in B.A.No.14968/25/ACP/III, dated 26.04.2016, by the official respondents to respondents 7 and 8. 2.

I have heard the submissions of the learned counsel for the petitioners and of the learned Standing Counsel appearing for respondents 3 and 4. I have perused material record. 3.

Learned counsel for the petitioners submits that the petitioners are the owners of the subject property of an extent of 1022 square yards in T.S.No.1035/2B at Ramnagar Division-19, Visakhapatnam, and that when the petitioners made an application, on 10.10.2014, for building permit, the same was returned unapproved vide proceedings B.A.No.14880/2015/ACPIII, dated 21.09.2015, and that later, the unofficial respondents 7 and 8 made an application for building permit and the same was granted and that as the application of the petitioners for building permit is also not considered by the official respondents 3 and 4, the present writ petition is filed.

Learned Standing Counsel appearing for respondents 3 and 4, on instructions, would submit that the building application of the petitioners was returned unapproved for non-compliance of certain requirements, which the petitioners were directed to fulfill and that later, the unofficial respondents 6 and 7 made an application along with necessary documents and link documents and that on being satisfied about the entitlement of the unofficial

respondents 6 and 7, the building permit was granted to them and that the application of the petitioners was already disposed of by the Commissioner, Greater Visakhapatnam Municipal Corporation, vide endorsement dated 08.11.2017, and therefore, the cause in the writ petition does not survive for adjudication. 5.

Recording the submissions, the writ petition is disposed of as no cause survives for adjudication, however, reserving liberty to the petitioners to assail the endorsement, dated 08.11.2017, if they are so advised or so desire.
