HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.46138 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 2nd respondent in issuing U.O. Note vide reference R.O.C.No.1738/2018 G1, dated 11.12.2018, by directing his staff to remove the electrical poles, transformers and loader in the premises of the petitioner situated at Door No.2/583/584, 2/584-1, 2/585, 2/285, Buddaipally, Jammalamadugu Town, Y.S.R Kadapa District, as illegal and arbitrary.
The case of the petitioner is that after construction of a hospital, the petitioner obtained permission for erection of electrical transformer and loader in the subject premises. After verification, the Electricity Board, erected the transformer and loader in the subject premises. While things stood thus, one Mr. M. Venkata Subba Reddy lodged a complaint before the respondent-authorities stating that the petitioner violated the building plan and got erected the transformer and electrical poles in the subject premises. The said M. Venkata Subba Reddy also filed a W.P.No.20978 of 2018, wherein this Court directed the Electricity Board to consider the representations of the petitioner in accordance with law.
In view of the orders of this Court, the respondent-authorities are contemplating to remove the electrical poles from the subject premises, without issuing any notice to the petitioner. Challenging the same, the present writ petition came to be filed. Since the power supply to the hospital/nursing home of the petitioner is very much essential and that the patents would be put to irreparable loss, if the power is disconnected abruptly, it would be just and proper for the authorities to put the petitioner on notice, give her an opportunity to explain and then proceed in accordance with law.
With the above observations, the writ petition is disposed of. No order as to costs.
As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
