This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner-A1, for grant of anticipatory bail in the event of his arrest in Crime No.92 of 2017 on the file of Ex.Serilingampally Police Station, registered for the offences punishable under Section 8(c) r/w 20 (b)(ii) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard the learned counsel for petitioner-A1, learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner would submit that the petitioner is innocent person and falsely implicated in this case. No ganja was seized from the possession of this petitioner and ultimately, prayed the Court to allow the application. 4 .

On the other hand, the learned Additional Public Prosecutor opposed the grant of bail to the petitioner-A1. 5 .

When the Prohibition & Excise Inspector and his staff went to the house of petitioner-A1 bearing No.1-61 situated at Lodha Basti, Nanakramguda Village, Serlingampally Mandal, Rangareddy District on 21.06.2017 at 7.35 A.M, the petitioner-A1 ran away from the house. On search of the house, they found 12.50 kgs of ganja in a plastic bag and the same was seized under the cover of panchanama. The punishment for the alleged offence is severe and the matter requires thorough investigation. It is also brought

to the notice of this Court that this petitioner is accused in other three criminal cases of similar nature. Under the circumstances, the petitioner-A1 is not entitled for bail under Section 438 Cr.P.C. Accordingly, the Criminal Petition is dismissed. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ Dr .
