This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.2, for grant of bail in Crime No.9 of 2017 of Donkarai Police Station, East Godavari District, registered for the offence punishable under Section 8(c) read with 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard the learned counsel for the petitioner/ A.2, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

The earlier bail application of this petitioner/ A.2 was dismissed by this Court, vide order, dated 05.06.2018, passed in Criminal Petition No.4397 of 2018, directing the trial Court to speed up the trial of case. There are no changed circumstances. The ganja alleged to have been seized in the subject crime is of commercial quantity. Under these circumstances, it is not a fit case to allow this application under Section 439 of Cr.P.C. 4 .

Hence, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
