Petitioners/A2 to A4 AND The State of Telangana rep. by its Public Prosecutor, High Court of Judicature at Hyderabad for the state of Telangana and the state of Andhra Pradesh. .....Respondent/Complainant Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to enlarge the petitioners on bail in Crime no. 951 of 2017 dated 14-12-2017 on the file of the SHO, Medipally Police Station, Rachakonda, LB.Nagar, in the event of their arrest.
The petition coming on for hearing, upon perusing the Petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri V Srikantha Rao, Advocate for the Petitioners, and of Public Prosecutor (TG) for Respondent, the Court made the following. ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioners, who are accused 2 to 4 in Crime No.951 of 2017 on the file of Medipally Police Station, Rachakonda District. The offences alleged are under Sections 498A, 323 and 506 IPC.
2. Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.
3. The counsel for the petitioners submits that A1 is already granted regular bail.
4. A perusal of the complaint shows that no allegations are levelled against these petitioners. The complainant categorically stated that there is a threat from her husband alone.
5. Hence, considering the above, this court opines that this is a fit case for granting anticipatory bail.
6. Accordingly, the Criminal Petition is allowed.
The petitioners/ A2 to A4 are directed to surrender before the III Metropolitan Magistrate, Medipally and Rachakonda at L.B.Nagar, within 15 days from the date of this order. On such surrender, the petitioners/ A2 to A4 shall be released on bail on their executing personal bonds for a sum of Rs.10,000/ - (Rupees ten thousand only) each with two sureties each in a like sum each to the satisfaction of the said Magistrate. Further, on such release, the petitioners/ A2 to A4 shall abide by the conditions mentioned under Section 438(2) Cr.P.C., as under:
i) The petitioners/ A2 to A4 shall make themselves available for interrogation by a police officer as and when required.
ii) The petitioners/ A2 to A4 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
iii) The petitioners/ A2 to A4 shall not leave India without the previous permission of the Court.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
