HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.46166 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not considering the representation dated 24.11.2018, submitted by the petitioners seeking to allot the Shop Nos.18 and 20 respectively in their favour, in the newly constructed Vegetable Market Complex, Sullurupeta, S.P.S.R. Nellore District, as illegal and arbitrary.

Learned counsel for the petitioners submits that though the petitioners submitted a representation to the 2nd respondent on 24.11.2018, seeking to allot the Shop Nos.18 and 20 respectively in their favour in the subject premises, since the same were in possession of the petitioners earlier, no action has been taken so far. The learned Standing Counsel for the 2nd respondent, on instructions, would submit that in view of the resolution passed, the persons who were in possession of the subject shops earlier, will be allotted the shops in the newly constructed Vegetable Market Complex, Sullurupeta, S.P.S.R. Nellore District.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent, to deal with the representation dated 24.11.2018 and allot two shops out of three remaining shops in favour of the petitioners herein in the newly constructed Vegetable Market Complex, Sullurupeta, S.P.S.R. Nellore District, as they were in possession of the shops at the said premises earlier. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
