HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.42168 OF 2017 ORDER:

The case of the petitioner is that she filed revision along with stay petition challenging the proceedings dated 18-07-2016 issued by the 4th respondent, whereby the 4th respondent affirmed the cancellation of fair price shop authorization of the petitioner. As no orders are passed, aggrieved by the same the present writ petition is filed. Learned counsel for the petitioner submits that in respect of stocks, variations are within permissible limits and other variations are trivial and vague in nature.

On the other hand, learned Assistant Government Pleader for Civil Supplies submits that due to violation of Control orders, fair price shop authorization has been cancelled, as such no interference is called for.

It is to be seen that a perusal of show-cause notice goes to show that variations are not grave in nature, but since revision is pending, this Court is not going into the merits of the case. In view of the same, the 2nd respondent is directed to dispose of the revision filed by the petitioner. Pending the same, there shall be suspension of the proceedings dated 17-06-2017 in A.C.D.Dis.No.22/2016-17 issued by the 3rd respondent as confirmed in the proceedings dated 18-07-2016.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 12-12-2017 Nvl
