THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.41461 of 2017 ORDER:

This writ petition is filed challenging the balance fee intimation, dated 18.11.2017, whereby the petitioner was informed to pay Rs.16,59,123/- towards payment of balance regularisation charges and was further directed to comply with the other requirements mentioned in the said intimation. In the said intimation, a reference was made to G.O.Ms.No.151, MA, dated 02.11.2015. After receiving the said intimation, the petitioner submitted a representation, dated 22.11.2017, to the respondents 2 & 3 requesting to recalculate the regularisation charges, inter alia, stating that according to the calculation of the petitioner, the amount due and payable would be Rs.3,74,286/- only.

At the hearing, learned counsel for the petitioner submits that if the said representation is directed to be considered and disposed of by the respondents 2 and 3 in terms of the afore-stated G.O and in accordance with the procedure established by law, the ends of justice would be met. Learned standing counsel representing the respondents 2 & 3 endorses the said submission.

Recording the afore-stated submissions, the Writ Petition is disposed of directing the respondents 2 and 3 to consider and dispose of the afore-said representation, dated 22.11.2017, of the petitioner, within three weeks from the date of receipt of a copy of this order, in terms of G.O.Ms.151, MA, dated

02.11.2015 and in strict accordance with the procedure established by law, and communicate the decision taken thereon to the petitioner within a week thereafter. There shall be no order as to costs.
