Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to direct the S.H.O., of Nallapadu Police Station, Guntur, Guntur Urban District, Andhra Pradesh, to release the Petitioner on bail in the event of her arrest in connection with Crime No. 562 of 2017 of Nallapadu Police Station, Guntur, Guntur District, Andhra Pradesh, in the interest of justice.
The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Dr. Challa Srinivasa Reddy, Advocate for the Petitioner and of Public Prosecutor(AP) on behalf of Respondent-State, the Court made the following ORDER :- "This petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused in Crime No.562 of 2017 on the file of Nallapadu Police Station, Guntur District, Andhra Pradesh. 2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, this petitioner submitted a no objection certificate of M/s.Cholamandalam Investment and Finance Co. ltd., Guntur, though the instalments were not cleared and the said certificate is a forged document.

The counsel for the petitioner contends that there was an agreement between this petitioner and the purchaser of the vehicle, wherein it was agreed that the instalments that are due to the M/s.Cholamandalam Investment and Finance Co. ltd., Guntur, would be paid by the purchaser. 5.
However, it is agreed by both counsel, that unless the loan is cleared, there would not be any transfer of registration. Hence, it is possible that there would be an effort on the part of the petitioner to create those documents. However, considering the plea of the petitioner's counsel that the petitioner is a pregnant woman, carrying six months pregnancy, this court opines that anticipatory bail can be granted to the petitioner. 6.
Accordingly, the Criminal Petition is allowed. The petitioner is directed to surrender before the Station House Officer, Nallapadu Police Station, Guntur, Guntur District, Andhra Pradesh, within 15 days from the date of this order. On such surrender, the petitioner shall be released on bail on her executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties in a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioner shall abide by the conditions mentioned under Section 438(2) Cr.P.C., as under: Contd.2..
- 2 - i) The petitioner shall make herself available for interrogation by a police officer as and when required.
ii) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
iii) The petitioner shall not leave India without the previous permission of the Court.
As a sequel, the miscellaneous applications, if any pending, shall stand closed."
