HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.13646 of 2018 ORDER :

Heard before admission and before notice to the 1st respondent in the quash petition filed by the petitioner/A.1 seeking to quash the proceedings in C.C.No.1682 of 2018 on the file of the XV Metropolitan Magistrate, Medchal, Ranga Reddy District, taken cognizance for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, out come of report of the 1st respondent/de facto complainant, no other than his wife, in Crime No.531 of 2017, dated 13.08.2017.

The petitioner/A.1 is shown in abscondance among the three accused and the learned Magistrate while taking cognizance, ordered to issue Non-Bailable Warrant (NBW) to A.1 and summons to A.2 and A.3. There is nothing to interfere with the order of the Court, but for from the submission that he is at abroad and going to appear and apprehending arrest by police in the transit from airport to the Court, so that he can move the Court for grant of bail and assurance of availability to face trial.

Thereby, the NBW is suspended for one month from today. In the meantime, the petitioner shall get down in India and move the trial Court for grant of regular bail with assurance of availability for future trial in person or through Advocate and any Special Vakalat holder, if permitted from the facts.
