It is the case of the petitioners that they are owners and pattadars of land admeasuring Ac.1-42 cents, Ac. 2.72 cents, Ac.1.00 cents, Ac.1-00 cents, Ac.1-00 cents, Ac.2-42 cents, Ac.1-10 cents, Ac.2-00 cents in Sy.Nos 831-B, 831-D, 831-A, 831-E, 831-F, 831-B, 831-C and 831-G of Gunjepalli Revenue Village, Mudigubba Mandal, Anantapuramu District respectively having purchased the same through registered sale deeds and they were issued pattadar passbooks and title deeds. The 4th respondent issued notice dated 05-11-2018 to the petitioner stating that they are intending to acquire the land for the purpose of the house sites and were instructed to file objections along with title documents before him within 15 days. That the petitioners filed objections before the 4th respondent on 19-11-2018.
Without considering their objections, the respondents are trying to evict the petitioners from the subject lands. Aggrieved by the same, the present writ petition is filed. Learned Assistant Government Pleader for Revenue produced written instructions stating that only preliminary notice was issued to the petitioners to find out whether they are willing to give consent for acquiring, if it is a private land or resumption of land, if it is DKT patta. If the petitioners are willing to part with the subject lands, the respondentauthorities will acquire the same after following due procedure
before taking any action. It is also stated that even before taking further action, the 4th respondent will pass necessary orders.
In view of the facts and circumstances of the case, the writ petition is disposed of directing the respondents not to dispossess the petitioners from the subject lands without following due procedure. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
