HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 46344 of 2018 ORDER:
The present writ petition came to be filed seeking the following relief:
" To declare the action of the 3rd respondent in not disposing the application of the petitioner dated 27.01.2006 for grant of lease to quarry road metal and building stone to an extent of 3.00 hectares in Survey No.223 of Rapaka Village, Ponduru Mandal, Srikakulam district, under A.P. Minor Mineral Concession Rules, 1966, even after lapse of more than 12 1⁄2 years, as being arbitrary, illegal, and unconstitutional and violative of Articles 19 and 300-A of the Constitution of India."

The grievance of the petitioner appears to be that inspite of No Objection Certificate being granted by the concerned authority, his application for grant of lease to quarry road metal and building stone is not being processed since more than twelve years.

Learned Government Pleader, on instructions, confirms pendency of the application of the petitioner since 2006, but, however, failed to explain the delay for processing the application.

In view of the above, the present writ petition is disposed of with consent, at the admission stage, directing
the respondents to deal with the application of the petitioner dated 27.01.2006 for grant of lease to quarry road metal and building stone to an extent of 3.00 hectares in Survey No.223 of Rapaka Village, Ponduru Mandal, Srikakulam district, and pass appropriate orders, in accordance with law, as early as possible, preferably, within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
