THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.13679 OF 2018 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.1, for grant of bail in Crime No.193 of 2018 of Zaheerabad Town Police Station, Medak District, registered for the offences punishable under Sections 366-A, 506 read with 34 of IPC and Sections 11 and 12 of POCSO Act, 2012.

Heard the learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

Learned counsel for the petitioner/A.1 would contend that the petitioner is an innocent person and falsely implicated in this case. He has nothing to do with the alleged offences and ultimately, prayed to allow the petition.

Learned Additional Public Prosecutor representing the State opposed the grant of bail to the petitioner/A.1 and ultimately, prayed to dismiss the petition.

The material placed on record reveals that A.1 took video of the victim girl-Naga Laxmi in his mobile phone without her consent. After commission of the alleged offence, the petitioner demanded her to come with him as and when he called. In the event of her not coming, he threatened the victim that he would put the video recorded by him in the social media. As per the record, the victim girl is 14 years old and the petitioner/A.1 is 22 years old. The allegations are specific and grave. The investigation is in progress. Release of the petitioner at this juncture would hinder the

investigation. There is possibility of threatening the witnesses. There are no justifiable grounds to allow the petition. 6.
