THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No.2556 of 2017 O R D E R:

This matter was taken up suo moto against the SubRegistrar, Punganur on the ground that he had willfully disobeyed the order dt.26.10.2016 in W.P.No.28407 of 2016 where under this Court had issued direction to his predecessor to consider registering the document produced by petitioner by taking into account the G.O.Ms.No.279 dt.04.07.2016 and also the order dt.15.03.2016 in W.P.MP.No.10609 of 2016 in W.P.NO.8374 of 2016. 2.

In W.P.No.39742 of 2017 the Government Pleader for Revenue has filed a counter affidavit stating that the petitioner had never claimed that he was an ex-serviceman when he applied for assignment and that the assignment was not made under ex-serviceman quota to the petitioner and so G.O.Ms.No.279 dt.04.07.2016 has no application. 3.

In view of the stand taken by the Sub-Registrar, which is supported by the copy of the application filed by the petitioner for assignment, I see no reason to continue this suo moto Contempt Case against the Sub-Registrar, Punganur. 4.

Accordingly, this Contempt Case is closed. No costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
