J. Balamani v. The State Of Telangana
THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.46333 of 2018 ORDER:
The grievance of the petitioner in this case is that her appeal is not being taken up by the Revenue Divisional Officer, Narsapur Division, Medak District. She claims to have filed the said appeal on 27.08.2018 in relation to the entries made by the Tahsildar, Shivampet Mandal, Medak District, in respect of land in Survey No.349/A admeasuring Ac.01.05 guntas situated at Chandi Village, Shivampet Mandal, Medak District, in favour of one Venkataram Veera Reddy, the fifth respondent herein. As the grievance of the petitioner is only with regard to the inaction of the appellate authority and this Court does not propose to enter into the merits of the matter, it is unnecessary to put the unofficial respondent on notice or afford him an opportunity of hearing. Learned Assistant Government Pleader for Revenue would inform this Court upon instructions that the appeal is yet to be numbered and taken up for hearing.
The writ petition is disposed of directing the Revenue Divisional Officer, Narsapur Division, Medak District, to entertain the appeal filed by the petitioner if it is otherwise found to be in order, take up the same for hearing after due notice is issued to the other side and adjudicate it on its own merits and in accordance with law. This exercise shall be completed expeditiously and in any event, not later than two months from the date of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:02.01.2019 Note:
