HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No. 3081 of 2017 ORDER:

Heard the learned counsel for the petitioner as well as the learned counsel for the respondents 2 and 3.

The present criminal revision case is filed questioning the order dated 27.09.2017 in M.C.No.296 of 2011 on the file of the Court of the Additional Metropolitan Sessions Judge for the Trial of Jubili Hills Bomb Blast Cases-cum-Additonal Family Court-cum-IX Additional Metropolitan Sessions Judge, Hyderabad, granting maintenance to the second respondent at Rs.7,000/ - per month from the date of filing of the petition i.e. 27.10.2011 till the date of order and thereafter Rs.15,000/ - per month and Rs.5,000/ - per month to the third respondent from the date of petition till 10.05.2012 on which date he attains the majority.

The facts in brief are that the second respondent is the legally wedded wife of the petitioner. Out of their wedlock, they were blessed with the third respondent. Since disputes arose between the petitioner and the second respondent, M.C.No.296 of 2011 was filed claiming maintenance for the respondents 2 and 3, on the file of the Court of the Additional Metropolitan Sessions Judge for the Trial of Jubili Hills Bomb Blast Cases-cum-Additonal Family Courtcum-IX Additional Metropolitan Sessions Judge, Hyderabad. After full-fledged trial, the learned Sessions Judge, was pleased to pass orders on 27.09.2017 awarding maintenance to the respondents 2

and 3, as stated supra. Aggrieved by the said orders, the present criminal revision case is filed.

Having heard both the learned counsel and from the perusal of the material on record, this Court is not inclined to interfere with the orders passed by the learned Sessions Judge. Accordingly, the criminal revision case is dismissed. However, the learned counsel appearing for the petitioner seeks permission of this Court to permit him to file an appropriate application for modification of the impugned orders before the Court below. Though such permission is not needed, but in the peculiar facts and circumstances of the case and acceding to the request of the learned counsel for the petitioner, petitioner is given liberty as prayed for. On filing such application, the learned Sessions Judge is directed to consider the same and pass appropriate orders as per law.

Miscellaneous petitions, if any, pending in this criminal revision case shall stand closed.
