HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.42404 of 2017 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents. 2.

Petitioner has filed this Writ Petition to declare the action of 3rd respondent in not conducting survey and fixing the boundaries pursuant to her application dt.04-12-2015.

Learned Government Pleader for Revenue had stated earlier that survey has already been done.

Though earlier on 19-12-2017 and 29-12-2017, this Court had directed the learned Government Pleader for Revenue to produce survey report of the survey claimed to have been done by the office of 3rd respondent, he has not produced the survey report except a statement of the Mandal Surveyor, Vijayawada Urban, to the effect that he went to the land, surveyed it and decided the boundaries. 5.

There is no survey sketch and there is no panchanama. Therefore, this statement of the Mandal Surveyor cannot be treated as a survey report by any stretch of imagination. 6.

Therefore, the Writ Petition is allowed and 3rd respondent is directed to cause a survey made by the Mandal Surveyor of Vijayawada Urban properly and furnish copy of the survey report with measurements/panchanama by fixing boundaries on the ground.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
