O R D E R
The petitioner is dealing in sale and purchase of chillers in the 4th respondent - Market Committee. Pursuant to cancellation of his licence, he applied for issuance of fresh licence. Now aggrieved by the action of respondents 2 to 5 in not considering his application submitted in Form -5 despite receiving licence fee as well as penalty, the present writ petition is filed.
The learned counsel for the petitioner and the learned Standing Counsel for respondents 4 and 5 - Agricultural Market Committee, submits that the issue involved in the present writ petition is squarely covered by an order passed by this court in W.P.No.27384 of 2017 and batch dated 23.08.2017 and that the present writ petition may also be disposed of in terms of the said order.
The relevant portion of the order dated 23.08.2017 in W.P.No.27384 of 2017 and batch reads as under:
" It is not disputed by the learned Standing Counsel for respondents 4 and 5 that the petitioners have applied as per the procedure contemplated under the aforesaid rules and they are entitled for licence and that he has not received any adverse remarks against the petitioners for denial of licence. In the circumstances, these writ petitions are allowed directing respondents 4 and 5 to consider the applications of the petitioners for issuance of licence and issue the same in accordance with law, within a period of fifteen days from the date of receipt of a copy of this order." The present writ petition is disposed of in terms of the above order of this court. Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
