THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL REVISION CASE No.3069 of 2017 ORDER:

The present Criminal Revision Case is filed questioning the order dated 01.11.2017 passed by the VI Additional Judicial Magistrate of First Class, Rajamahendravaram, in Crl.M.P.No.4147 of 2017 in C.C.No.1200 of 2008, whereby and whereunder, the petition filed by the petitioner - accused No.1 to recall NBW issued against him on 31.05.2002, was dismissed for his non-appearance. Heard Sri Sujith Jaiswal, learned counsel for the revision petitioner, and the learned Additional Public Prosecutor for the State of Andhra Pradesh.

The present revision case is misconceived for the reason that neither the order under challenge can be construed as a final order putting an end to lis nor can it be categorised as an intermediate order. The remedy lies by way of separate application under the relevant provisions of the Code of Criminal Procedure, 1973. Hence, the present Criminal Revision Case is dismissed. Miscellaneous Petitions, if any, pending in the present revision case, stand closed.
