HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 46339 of 2018 ORDER:
The present Writ Petition came to be filed seeking a writ of mandamus declaring the action of the 2nd respondent in seeking to mutate the names of the 4th and 5th respondents in the revenue records, and consequently to direct the 2nd respondent not to mutate the names of the 4th and 5th respondents in the municipal records, in respect of property of 120 sq.yards out of total extent of 373.21 sq.yards in House bearing No. 1-1-175, situated in Hazipura locality in Korutla. 2.
Though various grounds are raised in the present writ petition, the learned counsel for the petitioner mainly submits that though objections came to be filed by the petitioner on 29.09.2018 with regard to mutation of the names of the 4th and 5th respondents, the respondents are trying to mutate their names in the revenue records, without considering the said objections.

Sri N.Praveen Kumar, the learned Standing Counsel for Korutla Municipality, on instructions, states that mutation of the land in dispute has already been given effect to, and that no relief can be granted in this writ petition.

Therefore, the issue boils down to consideration of the objections raised by the petitioner with regard to mutation of the names of the 4th and 5th respondents in the revenue records. On the one hand, the learned Standing Counsel, on instructions states that mutation has already been given effect to, while the learned counsel for the petitioner submits that no mutation is done till date.

In view of the above, if no mutation of the names of the 4th and 5th respondents has been given effect to, the authorities shall take into consideration the objections raised by the petitioner, vide letter dated 29.09.2018 and pass appropriate orders thereon, in accordance with law, if necessary, after giving an opportunity to all the parties.

Accordingly, the writ petition is disposed of at the admission stage. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions pending if any, shall stand closed.
