HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.46409 of 2018 ORDER:

This writ petition is filed seeking a Writ of Mandamus, declaring the action of respondents in not granting 20 years Special Grade Increment consequent to completion of 20 years of service without any break in the respondent-Corporation which is contrary to Circular No.04/11, dated 12.01.2011, as arbitrary, illegal and unjust and sought a consequential direction directing the respondents to grant Special Grade Increment to the petitioner consequent upon completion of 20 years of service without any break, with effect from 2016. Heard Sri G.Ravi Mohan, counsel for petitioner and Sri B.Mayur Reddy, Standing Counsel for respondent-Corporation. It has been contended by the petitioner that he was initially appointed as a Driver in the respondent-Corporation during 1992.

The petitioner further contends that his services were also regularized and he was granted Special Grade Increment on completion of 12 years of service by the respondents and the petitioner is entitled for Special Grade Increment on completion of 20 years of service in pursuance to the Circular dated 18.02.2014, with effect from August 2016, but the respondents are not considering the case of the petitioner and are not granting Special Grade Increment in favour of the petitioner on completion of 20 years of service. Counsel for petitioner submits that the petitioner has submitted series of representations to the respondents and one such representation was made on 04.01.

respondents have not passed any orders on the said representation. Therefore, the counsel for petitioner contend that appropriate orders be passed in the writ petition directing the respondents to examine the representation submitted by the petitioner and pass appropriate orders in accordance with law.

Learned Standing Counsel appearing for respondent-Corporation contend that the case of the petitioner would be considered and appropriate orders would be passed in accordance with law. This Court, having considered the rival submissions of the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider and dispose of the representation submitted by the petitioner on 04.01.2018 and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With these observations, the writ petition is disposed of. No order as to costs.
