THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.42883 of 2017 ORDER:

The petitioner was appointed as Additional Programme Officer in the month of March, 2010, and was initially posted at Golugonda Mandal and thereafter he was transferred to Pedabayalu Mandal of Visakhapatnam District. In the 7th round of social audit certain irregularities were noticed and the petitioner was kept under suspension by order 18.08.2015. Challenging the same, the petitioner filed W.P.No.32156 of 2015 and this Court, by order dated 05.10.2015, disposed of the said Writ Petition directing the respondents to complete the enquiry against the petitioner and pass appropriate orders in accordance with law within a period of four weeks. Thereafter, the petitioner was issued a show cause notice on 29.10.2015 and the petitioner submitted his explanation on 07.11.2015.

It is now stated by the petitioner that without proper enquiry, an order of removal was passed on 28.11.2015 and against the said order, the petitioner preferred an appeal to the second respondent on 16.04.2016. When the second respondent did not dispose of the said appeal, the petitioner filed the present Writ Petition challenging the order of removal dated 28.11.2015. Since the regular appeal is pending before the second respondent against the impugned order dated 28.11.

appeal in accordance with law and pass appropriate orders thereon, within a period of four weeks from the date of receipt of a copy of this order.
