HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.No.11708 OF 2017 ORDER:

This criminal petition is filed under Section 482 of Cr.P.C. to quash the proceedings in C.C.No.2504 of 2017 on the file of I Additional Magistrate of First Class, Warangal. The petitioners are A2 to A4, who are brother-in-law and sister-in-laws and they are related to A1, who is at Malaysia. During hearing, learned counsel for the petitioners submitted that without touching the merits of the case, the presence of the petitioners may be dispensed with. But one has to represent the other accused even to pass an order under Rule 37 of the Criminal Rules of Practice and circular orders issued by this Court.

Therefore, the petitioners are permitted to file an application under Rule 37 of the Criminal Rules of Practice before the trial Court and on such application, after notice to the respondent, the Magistrate is directed to dispose of the said application in accordance with law, keeping in mind that the necessity of their appearance before the Court on every date of adjournment. With the above direction, without touching the merits of the case, the criminal petition is disposed of at the stage of admission. Pending miscellaneous petitions in the petition, if any, shall stand closed.
