Heard Sri Venkateswara Rao Gudapati, learned counsel for the petitioners, the learned Assistant Government Pleader for Roads and Buildings for respondents 1 & 3, learned Government Pleader for Revenue for the 2nd respondent, Sri Nimmagadda Venkateswarlu, learned Standing Counsel for the 4th respondent and Sri T. Jagadish Chandra Prasad, learned Standing Counsel for the 5th respondent.

The grievance of the petitioners is that the respondent authorities are proceeding to lay the roads by giving markings to their properties without issuing any notice or acquiring their properties and that if they are allowed to do so, they will be put to great hardship.

The learned counsel on both sides submit that in similar circumstances, some of the shop owners have filed W.P.No.38509 of 2017 and this Court, vide orders, dated 15.11.2017, and similar orders may be passed in this writ petition also. The relevant portion of the said order reads as follows:
"Following the aforesaid order and for the reasons recorded therein, this Writ Petition is also disposed of on the same lines to that of Writ Petition No.26402 of 2017, dt. 07.08.2017 directing the respondents not to meddle with the private property of the petitioner situated in Door Nos.8-12-12A, 8-12-12a/1, 8-12-12a and 8-12-14 situate at Lower Tankbund Road, RTC Complex Area, Ward No.8, Vizianagaram Municipality, Vizianagaram, except in accordance with law, if the same is required for public purpose. It is also made clear that if the respondents require the subject properties, they shall follow the due process of law."

Following the aforesaid order, the Writ Petition is also disposed of in terms thereof, at the admission stage. However, no orders as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
