P. Venkaiah v. The Honble Labour Court-Iii Hyderabad And 3
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20156 of 2003 ORDER:
When this matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation. The petitioner filed this writ petition challenging the award passed in I.D.No.148 of 1999 dated 19.5.2003 on the file of the 1st respondent, whereunder the I.D. preferred by the petitioner against the removal order, was dismissed.
The relief sought by the petitioner is to reinstate him into service. This Court having considered the circumstances of the case is of the view that at this point of time, reinstatement of the petitioner may not be possible. However, this Court is of the view that this writ petition can be disposed of directing respondents Nos.2 to 4 to pay the service benefits of the petitioner.
Accordingly, the Writ Petition is disposed of directing respondents Nos.2 to 4 to pay the service benefits of the petitioner for the services rendered by him prior to his removal, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ ABHINAND KUMAR SHAVILI, J 23rd November, 2018 Nn
