HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.42758 OF 2017 ORDER:
The petitioner is challenging the proceedings dated 20-11-2017, wherein and whereby the petitioner's service connections was provisionally assessed an amount of Rs.1,55,272/- and Rs.2,05480/- on the ground that there was theft of energy and the petitioner was directed to pay 50% of the assessed amount for restoration of power supply and payment of balance amount in two installments. Learned counsel for the petitioner says that the petitioner has not committed any theft of energy and the respondent-authorities have taken meter without knowledge of the petitioner. Heard Sri R.Vinod Reddy, learned Standing Counsel for the respondent-Corporation.
The petitioner can raise all these objections before the Special Court while determining the civil liability under Section 154 of the Electricity Act (for short "the Act"). For the present power connection to Service Connection Nos 2423 06210, 2423 06211 of the petitioner shall not be disconnected on payment of 50% of the total provisionally demanded amount of Rs.1,80,376/- i.e.Rs.90,000/- within four weeks from today. Further payment will be subject to determination of civil liability by the Special under Section 154 of the Act. However, the petitioner shall pay his regular monthly bills. With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
