HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.40974 OF 2017 ORDER:

This Writ Petition is filed assailing the action of the respondent No.2 in issuing the notice vide EC No.12/2017 dated 21.11.2017 under Sub-Section (1) of Section 4 of A.P.Public Premises (Eviction of unauthorized occupants) Act, 1968 and Amended act 15 of 1986 without any jurisdiction and without giving any details as illegal and arbitrary.

Heard learned counsel for the petitioner and Sri J.Srinivasa Rao, learned Standing Counsel for respondents. Normally this Court will not interfere at the stage of show-cause notice. Moreover, no exceptional grounds are made out for interference in the show-cause notice. In view of the same, it is open for the petitioner to submit explanation to the show-cause notice within a period of two weeks, raising all the objections, which are raised herein and the respondents are obligated to consider the same and pass orders in accordance with law. It goes without saying that unless and until order is passed, respondents shall not interfere with the possession of the petitioner and no coercive steps shall be taken against the petitioner till then. If the petitioner fails to submit explanation within the stipulated period of two weeks, it is

open for the respondents to take action in accordance with law.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this Writ Petition, miscellaneous petitions, if any, pending shall stand closed.
