Heard learned counsel for petitioner and learned Government Pleader for Panchayat Raj for respondents.

Consequent to tender notification dated 23.5.2018 inviting applications from registered manufacturers of solar P.V.water pumping systems, petitioner was successful bidder and he was granted letter of acceptance on 11.7.2018 and entered into an agreement on 18.7.2018. As per the agreement, entire work has to be completed within three months. After completion of 50 % of the civil work, six companies whose bids were disqualified, filed W P No. 26704 of 2018 challenging their disqualification. This Court by order dated 3.8.2018 granted interim order restraining official respondents from taking any further supplies from petitioner and another company. Petitioner being aggrieved by the said order seems to have moved an application to vacate the said interim order, while things stand so, this writ petition is filed alleging that respondents are intending to cancel the work order issued to the petitioner on the ground that work is not executed within the time granted and in the event of cancellation of the work order, grave prejudice would be caused.

Reading of the prayer itself would show that as of now, no decision is made and communicated to the petitioner canceling the work order granted to it. The work order granted to the petitioner is subject matter of W P No.26704 of 2018. Thus, as no adverse decision is taken against the petitioner, the writ petition is premature and the same is dismissed leaving it open to the petitioner to work out its remedies as and when cause arises. Miscellaneous petitions, if any pending, are closed.
