THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.41489 of 2017 ORDER:

In this writ petition, the grievance of the writ petitioner is that under the guise of expanding the existing road from 33 feet to 66 feet, the respondents 1 to 3 are attempting to demolish the petitioner's house bearing no.1-77/2 admeasuring 200 Square Yards situate at Bornapalli Village, Raikal Mandal, Jagityal District, without following due process of law. Learned counsel for the petitioner would submit that the petitioner is residing in the subject house since a long time by paying property tax. Learned Government Pleader for Roads & Buildings representing the respondents would submit that at present there is no proposal to widen the road and that if there is any such proposal, in future, the respondents would duly follow the procedure established by law. Recording the afore-said submissions, the Writ Petition is disposed of directing the respondents not to interfere with or demolish any part of the subject property of the petitioner; and, in the event there is any proposal for road widening, the respondents shall follow due process of law. There shall be no order as to costs.
