Merugu Laxmi Narayana v. The State Of Telangana
THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.46482 of 2018 ORDER:
The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a appropriate writ, order or orders, more particularly one in the nature of writ of mandamus and direct the respondent No.2 to 4 to cause survey and fix the boundaries by making Podi in Sy.No.50 to an extent of Ac.2-13 guntas situated at Kyatanpally Shivar, Mandamarri Mandal, Mancherial District, and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of Justice.' Perusal of the record however reflects that the petitioner made a hand written application seeking a survey without following the prescribed procedure of making an application online by way of a F-line petition along with the requisite fee.
Without making a proper application, it is not open to the petitioner to complain of inaction on the part of the revenue authorities. The writ petition is accordingly disposed of permitting the petitioner to make a proper application in the prescribed format along with the requisite fee. In the event such an application is made, the Tahsildar, Mandamarri Mandal, Mancherial District, shall take appropriate action thereon expeditiously and in any event, not later than eight weeks from the date of receipt of such application.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:28.02.2019 PGS
