This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the respondents in establishing "Anna canteen" in the private land of the petitioner and others, used as irrigation channel and pathway in Sy.No.569/1 to an extent of Ac.1.88 cents and in Sy.No.569/2 to an extent of Ac.0.07 cents, situated at Vinjamur Village and Mandal, SPSR Nellore District, as arbitrary and illegal.

Heard learned counsel for the petitioner, the learned Assistant Government Pleader for Revenue appearing for respondents 1 to 4 and learned Assistant Government Pleader for Irrigation and Command Area Development appearing for the 5th respondent. 3.

Learned Assistant Government Pleader for Irrigation and Command Area Development appearing for 5th respondent submits that there is no proposal of establishment of "Anna Canteen" in the subject lands as alleged by the petitioners.
