HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL REVISION CASE No.3217 OF 2017 JUDGMENT:

The present Criminal Revision Case, under Sections 397 and 401 of the Code of Criminal Procedure, 1973, is preferred by the petitioner in Criminal M.P. No.2496 of 2016, delay condonation petition, in an unnumbered Criminal Appeal on the file of Sessions Court, Guntur, requesting to set aside the order dated 31.08.2017, in the said petition which was passed pursuant to the condition imposed in the main order dated 08.08.2017 in the same petition.

2. Heard Sri G.L. Nageswara Rao, learned counsel for the revision petitioner, and perused the material on record.

3. Since the main petition was already allowed by the order dated 08.08.2017, but, later dismissed by the order dated 31.08.2017, for want of non-compliance of the condition imposed in the order dated 08.08.2017, it is opined that there is no need to issue notice to respondent Nos.1 and 2.

4. When kept in view, the endeavour of the Court is to render justice, though, there is latch on the part of the revision petitioner which can be rectified, the present Criminal Revision Case is allowed, at the admission stage itself, setting aside the order dated 31.08.2017, directing the revision petitioner to deposit the costs of Rs.500/- (Rupees five hundred only) imposed by the Court below by the order

Crl.R.C. No.3217 of 2017 ASN,J dated 08.08.2017, within two (2) weeks from today i.e., by 27.12.2017.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the present revision case stand closed.
