.....Respondent/ Complainant Petition under Section 437 & 439 of Cr.P.C praying that the High Court may be pleased to grant bail to the petitioner's in SC No.119 of 2017 ariging out of crime no.30/2017 on the file of I Addl. District & Sessions Judge Court, Rajahmundry on such terms and conditions as this Hon'ble court deems fit to enlarge the petitioners/accused Nos.2 and 4 on Bail till final disposal of the case.

The petition coming on for hearing, upon perusing the Petition and the memorandam of grounds filed in support thereof and upon hearing the arguments of SRI BHANOTHU HUSSAIN Advocate for the Petitioners and of Public Prosecutor for the Respondent and the Court made the following. This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ accused Nos.2 and 4, for grant of bail in S.C.No.119 of 2017 on the file of I Additional District and Sessions Judge's Court, Rajahmundry, for the offence punishable under Section 20 (b) (i) (c) read with Section 8 (c) of Narcotic Drugs and Psychotropic Substances Act, 1985.

2 . Heard the learned counsel for the petitioners/ accused Nos.2 and 4, learned Additional Public Prosecutor representing the respondent-State and perused the record.

3 . It is brought to the notice of the Court that 8 Kgs. of ganja alleged to have seized from the possession of each of the petitioners/ accused Nos.2 and 4 on 09.04.2017. The petitioners were remanded to judicial custody on that day only. Accused Nos.1 and 3 were granted bail by this Court in Crl.P.No.11026 of on 20.11.2017.

The allegations against these petitioners are similar to the allegations made against accused Nos.1 and 3.

4 . Under these circumstances, the petitioners/ accused Nos.2 and 4 are ordered to be released on bail on each of them executing a personal bond for a sum of Rs.25,000/ - (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge, Rajahmundry, East Godavari District. One of the sureties shall be from Warangal District. 5 . The Criminal Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
