THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.43644 and 43942 of 2017 COMMON ORDER:

These two Writ Petitions are filed seeking to declare the action of the fifth respondent in refusing to delete petitioners' lands situated in Nowluru and Kuragallu Villages, Mangalagiri Mandal, Guntur District, from the Annexure to G.O.Ms.No.197, dated 05.05.2016, by passing an order, dated 01.12.2017, as arbitrary and illegal and consequently, to set aside the same.

When the matter is taken up for hearing, it is represented by learned counsel for the petitioners that when Writ Appeals were preferred pursuant to interim orders in W.P.M.P.No.52138 of 2017 in W.P.No.42035 of and W.P.M.P.No.52130 of in W.P.No.42027 of 2017, the Division Bench of this Court disposed of the said appeals directing the State Level Committee itself to decide the issue.

In view of the said order of the Division Bench of this Court, learned counsel for the petitioners submits that these two Writ Petitions also can be disposed of. The same is not disputed by learned Government Pleader appearing for the respondents. 4.

In the circumstances, these two Writ Petitions are disposed of giving liberty to the petitioners to submit a representation for deletion of their lands from the list of prohibited lands. As and when such representation is filed, it is for the Committee to pass orders thereon, within a period of eight (08) weeks from the date of receipt of a copy of this order, after giving opportunity of being heard to the petitioners.
