THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.40984 of 2017 ORDER :

Heard the counsel for petitioners, and the learned Government Pleader for Revenue, for respondents.

The petitioners have assailed in this Writ Petition proceedings dt.23.08.2016 of the 3rd respondent refusing to mutate the names of petitioners in the Revenue Records.

The petitioners contend that before passing the impugned order the 3rd respondent did not give any notice to them, and that this has vitiated the impugned order.

The learned Government Pleader for Revenue, appearing for respondents, states that the 3rd respondent ought to have issued notice to petitioners before passing the impugned order. 5.

Therefore, the impugned order is set aside. The matter is remitted back to the Tahsildar, Gandipet Mandal, and the Tahsildar, Gandipet is directed to consider petitioners' application for mutation made on 22.02.2016 and take appropriate action in that regard after giving notice to petitioners.

Accordingly the Writ Petition is disposed of with the above directions. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
