2. Alluri Haribabu, S/o. Narayan Reddy Petitioners (Accused 1 & 2 in Cr.No.123/2017 of P.S.Jainath) AND The State of Telangana, rep. by its Public Prosecutor, High Court of Judicature at Hyderabad.
Respondent Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioners/Accused Nos. 1 and 2 on bail in connection with Crime No. 123 of 2017 of Jainath P.S., Adilabad District during the pendency of inquiry and trial. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri T.Sujan Kumar Reddy, Advocate for the Petitioners and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
" This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioners, who are A1 and A2, on bail in Crime No.123 of 2017 on the file of Jainath Police Station. The offences alleged against the petitioners are under Section 307 r/w 34 IPC. 2.
Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

As per the case of the prosecution, the petitioners throttled the neck of the victim and tried to kill him.

The counsel for the petitioners submits that there was a land dispute between the parties and that lead to filing of this false case. 5.
However, the material part of the investigation is completed, material witnesses were also examined and petitioners are stated to have been in jail since 25.11.2017.

Hence, considering the above circumstances, the Criminal Petition is allowed and the petitioners are directed to be enlarged on bail on condition of their executing personal bonds for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties each for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Adilabad, and to appear before the trial Court on the dates given by the concerned Court.
