HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 46653 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the order of the fourth respondent passed in Rc.No.192/ 2017/ A4 dated 07.12.2018, as illegal and arbitrary and consequently direct the fourth respondent to permit the petitioner to conduct the business.
2) The main ground urged by the learned counsel for the petitioner is that except the confession, there is no material to show that the petitioner is responsible for selling the loose liquor. Even otherwise, he would submit that the licence is suspended for a month and since last 22 days the petitioner has closed down the shop.
3) Having regard to the fact that since morethan 22 days the licence of the petitioner has been suspended, it would be just and proper to reduce the suspension to the period already completed. 4) Accordingly, the Writ Petition is disposed of reducing the period of suspension of A4 licence of the petitioner to the period already completed. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as costs.
