THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.13715 OF 2018 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioners/Accused Nos.2 and 3, for grant of bail in Crime No.256 of 2018 of Aswaraopeta Police Station, Bhadradri - Kothagudem District, Telangana State, registered for the offences punishable under Sections 302, 201 and 120-B read with 34 of the Indian Penal Code, 1860.

2. Heard the learned counsel for the petitioner/accused Nos.2 and 3, the learned Additional Public Prosecutor representing respondent - State, and perused the record.

3. There are specific and grave allegations against the petitioners herein indulging in the commission of murder of Madupu Papa Chary. The petitioners along with accused No.1 alleged to have committed the offence in view of land dispute. Accused No.1 including the petitioners pressurized the deceased to sell his land to them. All the accused belong to one family. There is stringent punishment for the alleged offence, which may extend to imprisonment for life or death. Investigation is in progress. Release of the petitioners on bail would certainly hamper the investigation. The present Criminal Petition is devoid of merits and the same is liable to be dismissed.

4. The Criminal Petition is, accordingly, dismissed. As a sequel, miscellaneous petitions, if any pending in the present Criminal Petition, stand closed.
