As the issue involved in all these writ petitions is arising out of G.O.ms.No.197 Revenue (Assignment-I) Department, dated 05.05.2016, they are being heard together and disposed of by way of this Common Order.

Heard Sri P.Roy Reddy, learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for respondents.

In all these Writ Petitions, the subject lands as mentioned in the affidavits filed in support of the writ petitions, are situated in Pottur village, Guntur Mandal and District. A perusal of the impugned proceedings i.e., G.O.Ms.No.197, Revenue (Assignment-I) Department, dated 05.05.2016 goes to show that even though the subject lands are assigned prior to 1954, they have been included in the list of prohibited properties under Section 22-A of the Registration Act, 1908 . The Government of Andhra Pradesh has issued G.O.Ms.No.575, dated 16.11.2018 for deletion of lands which are assigned prior 1954, from the list of prohibited properties as per Section 22-A of the Registration Act. When impugned proceedings show that the subject land is assigned prior to 1954, the question of continuation of the same in the list of prohibited properties under Section 22-A of the Act does not arise.

In view of the same, the lands which are assigned prior to 1954 are liable to be deleted from the annexure attached to impugned

G.O.Ms.No.197, Revenue (Assignment-I) Department, dated 05.05.2016 issued by the 1st respondent.

Accordingly, these writ petitions are allowed directing the 1st respondent to delete the subject lands, which are assigned prior to 1954, from the annexure to G.O.Ms.No.197, Revenue (Assignment-I) Department, dated 05.05.2016. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
