THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.42231 of 2017 ORDER:

It is the case of the petitioner that he was initially appointed as Junior Assistant and while he was working as Chief Executive Officer of the second respondent he was kept under suspension by proceedings dated 08.09.2014 alleging misappropriation of funds by him. Thereafter an enquiry was conducted and he was held responsible for the loss of Rs.49,984/-. He further states that the same Enquiry Officer conducted the second enquiry and came to the conclusion that he misappropriated Rs.32,51,181/-. Ultimately an order of dismissal from service was passed against the petitioner on 05.07.2017 and it was served on him on 15.07.2017. Against the same the petitioner preferred an appeal to the third respondent on 11.08.2017. When the same was not disposed of during the last three months, the present Writ Petition is filed.

Since the appeal is pending before the third respondent, this Court is not inclined to go into the merits of the case, but directs the third respondent to dispose of the same as expeditiously as possible, but not later than two months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of.
