HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.46523 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the 4th respondent in not conducting survey and demarcation of the petitioners' land to an extent of Ac.1-76 cents out of Ac.3-94 cents in Survey No.319/4 situated at Narva (Sathivanipalem) hamlet of Pendurthi Village and Mandal, Visakhapatnam District, as arbitrary and illegal and consequently, direct the 4th respondent to consider the representation, dated 09.08.2018.

Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue appearing for respondents.

Learned Assistant Government Pleader, on instructions, submits that the petitioners have not made application through F-line for survey and demarcation of the subject land. However, learned counsel for the petitioners submits that the petitioners made representation on 09.08.2018 for survey and demarcation, but till date no orders are passed.

Having regard to the above, without going into the merits of the case, the present Writ Petition is disposed of directing the petitioner to make a fresh application through F-line seeking survey and demarcation in respect of the land to an extent of Ac.1-76 cents out of Ac.3-94 cents in Survey No.319/4 situated at Narva (Sathivanipalem) hamlet of Pendurthi Village and Mandal, Visakhapatnam District. On filing of such application, the

respondent authorities shall consider and dispose of the same in accordance with law.
