THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.12322 of 2017 ORDER:

The present Criminal Petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the Code') to quash the First Information Report in Crime No.78 of 2017 of Godavarikhani II Town Police Station, Peddapalli District.

2. After arguing the case for a while, learned counsel for the petitioner requested this Court to direct the concerned S.H.O. to follow the procedure under Section 41-A of the Code and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1.

Acceding to the request of learned counsel for the petitioner, the Station House Officer, Godavarikhani II Town Police Station, Peddapalli District, is directed to follow the procedure under Section 41-A of the Code and the guidelines issued by the Apex Court in Arnesh Kumar (supra).

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in the Criminal Petition stand closed.
