Petition filed under Sections 438 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to enlarge the petitioner on bail in the event of their arrest in Crime No. 21 of 2015, dated 1202-2015 of Tripuraram Police Station, Nalgonda District. The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of K. Ravinder Reddy, Advocate for the Petitioners and of Public Prosecutor(TS) on behalf of RespondentState, the Court made the following ORDER :- "This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A6, A8 and A9, in Crime No.21 of 2015 on the file of Tripuraram Police Station, Nalgonda District. The offences alleged are under Sections 418, 409 and 420 IPC.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The allegations in the complaint are that the programme of Indira Jala Prabha is divided into nine clusters for effective implementation of the scheme. The scheme was divided and handed over to concerned sections incharge. The Project Director & Addl.DPC, MGNREGS, Nalgonda gave a complaint against the execution of the IJP works at Triupraram Mandal for implementation of the said scheme. The Commissioner for Rural Development had ordered for enquiry and the concerned team inspected the works and submitted a detailed report against the respective persons with regard to the irregularities, fraud and cheating against the norms of the scheme. 4.
However, the counsel for the petitioners submits that a quash petition was moved by the petitioners and while disposing of the said quash petition, the police were directed to issue notice under Section 41-A of Cr.P.C. to the accused. The counsel also takes this court through the proceedings of the District Collector, Nalgonda, by virtue of which the petitioners herein were warned and penalty of Rs.2,000/- was imposed and they were also reinstated in the existing vacancies.

Hence, in the above circumstances, this court opines that this is a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is allowed. The petitioners are directed to surrender before the Station House Officer, Tripuraram Police Sattion, Nalgonda District, within 15 days from the date of this order. On such surrender, the petitioners shall be released on bail on their executing personal bonds for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties each for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioners shall abide by the conditions mentioned under Section 438(2) Cr.P.C., as under: Contd.2..
- 2 - i) The petitioners shall make themselves available for interrogation by a police officer as and when required.
ii) The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
iii) The petitioners shall not leave India without the previous permission of the Court.
As a sequel, the miscellaneous applications, if any pending, shall stand closed."
