O R D E R

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents.

As per the averments made in the writ affidavit, the petitioner is a Society, registered under the A.P. Co-operative Societies Act, 1964. It consists of 558 members, who are employees of Police Department. The land belonging to the Society is located in Sy.No.122/ 10 of Mamidipalem village, Ongole Mandal, Prakasam District. The land is situated in an extent of Acs.29-92 cents. The Mandal Revenue Officer handed-over the possession to the Society and since then, the members of the petitioner - Society, have been in possession and enjoyment of the property. The petitioner wanted to register the plots in favour of members of the Society and when the documents were presented for registration, the 4th respondent issued letter on 06.02.

2017, stating that the property is included in the list of prohibited properties under Section 22-A of the Registration Act, 1908 (for short 'the Act'). In these circumstances, petitioner submitted a representation on 15.02.2017 to the 2nd respondent for deletion of the said property from the list of prohibited properties and when no orders were passed by 2nd respondent till date, the present writ petition is filed. A Full Bench of this court in Vin j am u r i Raj agopala Ch ar y an d Ot h er s v s. St at e of A.P.,1 considered the issue relating to properties included under Section 22-A of the Act and gave liberty to the affected parties to approach the competent authority for deletion of the properties and in the instant case, petitioner - Society already approached the 2nd respondent by submitting representation dated 15.02.2017.

in the light of the records available with him and pass appropriate orders in accordance with law, within three months from the date of receipt of a copy of this order.

The writ petition is accordingly disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
